When To Use:
Section 4024 of the Coronavirus Relief and Economic Security (“CARES”) Act temporarily prohibits the filing of eviction actions for the non-payment of rent in “covered dwellings” if those dwellings are in “covered properties.” In general, a “covered property” is any property that receives a federal rent subsidy, participates in a federal housing program, or has a federally-backed or insured mortgage. If you are unsure, please read the actual language of the Act before completing this Affidavit. This form should be used to advise the Court that the Property that is involved in the eviction action is not covered by the CARES Act or the CARES Act is not applicable.
