When To Use the 30-Day Notice Terminating Tenancy For Failure To Pay Rent No Right To Cure
(1) Tenancy for one year or less or year-to-year tenancy when tenant fails to pay rent for the second time within a 12-month period and the rental is a “covered property” under the CARES Act, which includes any property that (a) participates in: (i) a covered housing program, as defined in section 41411(a) of the Violence Against Women Act of 1994 (34 U.S.C. 12 12491(a)); or (ii) the rural housing voucher program under section 542 of the Housing Act of 1949 (42 U.S.C. 1490(r)); or (b): has a (i) Federally backed mortgage loan; or (ii) Federally backed multifamily mortgage loan.
(2) Month-to-month or week-to-week tenancy when tenant fails to pay rent and the rental property is a “covered property” under the CARES Act (see above). Wis. Stat. § 704.17 and Sec. 4024 of the CARES Act.
